1. Acceptance of Terms
Welcome to Greyhawk Forensics & Cybersecurity (“Greyhawk,” “we,” “us,” or “our”). By accessing or using our website located at https://greyhawkforensics.asia/ (the “Site”) or by contacting us to inquire about our services, you agree to be bound by these Terms of Service (“Terms”).
If you do not agree to these Terms, you must not access or use our Site.
2. Scope of Services & Separate Agreements
These Terms govern your use of the Greyhawk website and initial communications. However, the actual provision of digital forensics, incident response, reverse engineering, or cybersecurity services will be governed by separate, mutually executed agreements, including but not limited to:
- Non-Disclosure Agreements (NDAs)
- Formal Scopes of Work (SoW)
- Master Service Agreements (MSA)
In the event of any conflict between these Website Terms of Service and a fully executed SoW or MSA, the terms of the specific SoW or MSA shall prevail.
3. Professional Disclaimers
Greyhawk provides highly specialized technical investigation and cybersecurity auditing services. By utilizing our Site and Services, you acknowledge the following:
- No Legal Advice: Greyhawk is a technical forensic and cybersecurity firm, not a law firm. Our reports, findings, and consultations constitute technical evidence and expert opinion, not legal advice. Clients are strictly advised to consult with their retained legal counsel regarding regulatory compliance, Data Privacy Act (RA 10173) obligations, and litigation strategies.
- No Guarantee of Recovery:Â Digital forensics and data recovery are subject to the physical and logical state of the media upon receipt. Greyhawk does not guarantee the successful recovery of deleted data, encrypted files, or hardware functionality if the evidence has been overwritten, physically destroyed, or fundamentally compromised prior to our engagement.
- Destructive Testing Risks:Â Certain advanced hardware forensics and reverse engineering methodologies (e.g., chip-off extraction, fault injection, decapping) carry inherent risks of permanent physical damage to the target device. Greyhawk requires explicit written consent before performing potentially destructive testing and assumes no liability for the loss of hardware functionality during authorized exploitation.
4. Intellectual Property Rights
The Site and its original content, features, functionalities, and proprietary methodologies—including references to our proprietary platforms such as Jera 5.0, Hawk-Eye AI, and Forensic Captain—are and will remain the exclusive property of Greyhawk Forensics & Cybersecurity and its licensors.
The Site is protected by copyright, trademark, and other intellectual property laws of the Republic of the Philippines and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Greyhawk.
5. Client Authorization & Lawful Mandate
Greyhawk operates strictly within the bounds of national and international law. By engaging Greyhawk for investigative or reverse-engineering services, you represent and warrant that:
- You are the lawful owner of the digital media, hardware, or software being submitted, OR
- You possess explicit, written legal authorization (such as corporate authority or a court order) to authorize Greyhawk to conduct forensics, penetration testing, or reverse engineering on the target systems.
Greyhawk reserves the right to refuse service or terminate an engagement immediately if we suspect the services are being requested for unlawful purposes or without proper authorization.
6. Prohibited Uses of the Website
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:
- In any way that violates any applicable national or international law or regulation.
- To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
- To impersonate or attempt to impersonate Greyhawk, a Greyhawk employee, another user, or any other person or entity.
- To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site (including submitting malicious payloads through our contact forms).
7. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Greyhawk Forensics & Cybersecurity, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Site;
- Any conduct or content of any third party on the Site;
- Any unauthorized access, use, or alteration of your transmissions or content.
8. Indemnification
You agree to defend, indemnify, and hold harmless Greyhawk Forensics & Cybersecurity and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of:
a) your use and access of the Site;
b) your breach of these Terms; or
c) any misrepresentation of ownership or legal authorization regarding hardware or data submitted to Greyhawk for analysis.
9. Governing Law & Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
Any dispute arising from these Terms or the use of the Site shall be subject to the exclusive jurisdiction of the competent courts of Quezon City, Metro Manila, Philippines.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms.
